1. Acceptance of Terms

By accessing or using the Services, you confirm that you are at least 13 years of age (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

We reserve the right to modify or update these Terms at any time, at our sole discretion. Changes will be effective upon posting the updated Terms within the App or on our website. We will notify you of material changes through the App, by email, or via other reasonable means, as required under the Consumer Protection Act, 2019. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must discontinue using the Services.

2. Description of Services

Crompt AI is a mobile application that aggregates multiple third-party artificial intelligence models into a single platform, allowing users to interact with AI technologies such as OpenAI's GPT models, Claude, Gemini, Mistral, xAI's multi-modal, and DeepSeek. The App enables users to access a range of AI-powered functionalities, including but not limited to text generation, question answering, task assistance, and content creation, subject to the limitations and restrictions outlined in these Terms.

2.1 Free and Subscription Plans

Crompt AI offers both free and paid access to the Services:

• Free Plan: Users can access the Services for free, subject to dynamic usage limits determined by Crompt AI. These limits may include restrictions on the number of queries, interactions, or access to specific AI models. Usage limits are subject to change at our discretion and may vary based on system capacity, user demand, or third-party AI provider restrictions. We will notify users of significant changes to free plan limits through the App or other reasonable means, in line with fair business practices under Indian law.

• Subscription Plans: Crompt AI offers premium subscription plans on a weekly or monthly basis, which provide enhanced access to the Services, including higher usage limits, priority access to certain AI models, and additional features. Subscription plans are subject to the pricing and terms displayed in the App at the time of purchase, inclusive of applicable taxes such as Goods and Services Tax (GST). Subscriptions are managed through the Google Play Store or Apple App Store, as applicable, and are subject to their respective payment and billing policies.

2.2 Dynamic Usage Limits

Usage limits for the free plan are dynamic and may be adjusted by Crompt AI at any time without prior notice, subject to providing reasonable communication to users as per applicable consumer protection laws. Factors influencing these limits include server capacity, third-party AI provider restrictions, and overall system performance. We strive to provide a fair and equitable experience for all users, but we do not guarantee specific levels of access under the free plan.

3. User Accounts and Registration

To use certain features of the Services, you may be required to create an account ("Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to ensure it remains accurate. You are responsible for maintaining the confidentiality of your Account credentials, including your password, and for all activities that occur under your Account.

You must notify us immediately if you suspect unauthorized access to or use of your Account. Crompt AI is not liable for any loss or damage arising from your failure to safeguard your Account credentials, except as required under applicable Indian laws, such as the Information Technology Act, 2000.

You may not transfer or share your Account with any other person, and you may not use another person’s Account to access the Services. We reserve the right to suspend or terminate your Account if we suspect fraudulent, abusive, or unauthorized activity, in accordance with fair practices.

4. Subscriptions and Payments

4.1 Subscription Plans

Crompt AI offers weekly and monthly subscription plans, which automatically renew unless canceled by you before the renewal date. Subscription fees are charged in advance through the Google Play Store or Apple App Store, depending on the platform from which you downloaded the App. Pricing and available subscription plans are displayed in the App, inclusive of applicable taxes (e.g., GST), and may vary by region or currency.

4.2 Payment Processing

All payments for subscriptions are processed through the Google Play Store or Apple App Store. By subscribing, you agree to their respective payment terms, including any applicable taxes or fees. You must provide a valid payment method and authorize the relevant app store to charge your payment method for the subscription fees. Payments are subject to the Payment and Settlement Systems Act, 2007, and other applicable Indian regulations.

4.3 Subscription Cancellation

You may cancel your subscription at any time through your Google Play Store, Apple App Store, or web account, depending on how you originally subscribed. If a subscription is canceled through the web platform, it will also be reflected and canceled in the corresponding App Store or Play Store account, and vice versa.Cancellation takes effect at the end of the current billing cycle, and you will continue to have access to the subscription benefits until that time.

Please note, Crompt AI does not offer refunds or credits for partial billing periods or unused time, as it is a digital platform providing instant access to multiple AI models and tools.

Refunds, if applicable under exceptional cases governed by the Consumer Protection Act, 2019 or any applicable law, will be processed within 5–7 working days, and the amount will be credited to your account based on standard banking timelines.

4.4 Changes to Subscription Terms

We reserve the right to modify subscription pricing, features, or availability at any time, subject to providing notice as required under Indian consumer protection laws. We will notify you of material changes to your subscription plan through the App or by email. If you do not agree with the changes, you may cancel your subscription as described above. Continued use of the Services after such changes constitutes your acceptance of the updated subscription terms.

4.5 Refunds

Except as required by the Consumer Protection Act, 2019, or the policies of the Google Play Store or Apple App Store, all subscription fees are non-refundable. If you believe you are entitled to a refund due to defective service or other valid reasons, you must contact the respective app store directly or reach out to us at support@crompt.ai. Refund requests will be evaluated in accordance with applicable laws and our internal policies.

5. User Conduct and Acceptable Use

You agree to use the Services in compliance with these Terms, applicable Indian laws (including the Information Technology Act, 2000, and the Indian Penal Code, 1860), and the policies of the Google Play Store and Apple App Store. You are solely responsible for your interactions with the Services and any content you generate or submit through the App ("User Content").

5.1 Prohibited Activities

You may not engage in any of the following activities while using the Services:

• Violating any applicable Indian or international laws, including but not limited to the Information Technology Act, 2000, and rules related to cybercrimes or data protection.

• Using the Services to generate, distribute, or promote content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable under Indian law.

• Attempting to bypass usage limits, access restrictions, or security measures implemented by Crompt AI or third-party AI providers.

• Reverse-engineering, decompiling, or otherwise attempting to derive the source code or underlying technology of the App or Services, except as permitted under Indian law.

• Using the Services for commercial purposes without our prior written consent, except as expressly permitted under these Terms.

• Interfering with or disrupting the operation of the Services, including by introducing viruses, malware, or other harmful code.

• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

• Collecting or harvesting personal information from other users without their consent, in violation of the Digital Personal Data Protection Act, 2023 (if applicable).

• Using the Services in a manner that infringes the intellectual property rights, privacy rights, or other rights of any third party.

5.2 User Content

You retain ownership of any User Content you create or submit through the Services. However, by using the Services, you grant Crompt AI a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, and display your User Content solely for the purpose of operating, improving, and providing the Services.

You represent and warrant that your User Content does not violate any applicable Indian laws, infringe the rights of any third party, or violate these Terms. Crompt AI reserves the right to remove or disable access to any User Content that we believe violates these Terms, applicable laws, or is otherwise objectionable, at our sole discretion.

6. Intellectual Property

6.1 Ownership of Services

The App, Services, and all related content, including but not limited to software, designs, logos, trademarks, text, graphics, and user interfaces (collectively, "Crompt AI Content"), are owned by Crompt AI or its licensors and are protected by copyright, trademark, and other intellectual property laws under the Indian Copyright Act, 1957, and other applicable laws. You may not copy, modify, distribute, sell, or create derivative works based on Crompt AI Content without our prior written consent.

6.2 Third-Party AI Models

The Services integrate third-party AI models, including OpenAI's GPT models, Claude, Gemini, Mistral, xAI's multi-modal, and DeepSeek, which are owned and operated by their respective providers. Your use of these AI models through the App is subject to the terms and conditions of the respective providers, as applicable. Crompt AI does not claim ownership of these third-party AI models or their outputs, except as necessary to provide the Services.

6.3 License to Use the Services

Subject to your compliance with these Terms, Crompt AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App and Services for personal, non-commercial purposes. This license does not include any right to resell, sublicense, or otherwise commercialize the Services or Crompt AI Content.

7. Third-Party Services and Content

The Services may include or provide access to third-party services, content, or websites, including the AI models mentioned above. These third-party services are governed by their own terms of service and privacy policies, which you are responsible for reviewing. Crompt AI is not responsible for the availability, accuracy, or content of any third-party services or content, and we do not endorse or warrant such services or content.

8. Privacy

Your privacy is important to us. Our Privacy Policy, available within the App and on our website, explains how we collect, use, disclose, and protect your personal information in compliance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (if applicable), and other relevant Indian laws. By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.

9. Termination

9.1 Termination by You

You may terminate your use of the Services at any time by uninstalling the App, canceling your subscription (if applicable), and ceasing to access the Services. Termination does not entitle you to a refund for any prepaid subscription fees, except as required by the Consumer Protection Act, 2019, or other applicable laws.

9.2 Termination by Crompt AI

We reserve the right to suspend or terminate your access to the Services, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive activity, or for any other reason at our sole discretion, subject to providing reasonable notice as required under Indian law. Upon termination, your Account and right to access the Services will be revoked, and any User Content associated with your Account may be deleted.

9.3 Effect of Termination

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Crompt AI will not be liable for any damages or losses resulting from the termination of your access to the Services, except as required by applicable law.

10. Disclaimers

10.1 General Disclaimer

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Crompt AI does not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10.2 AI Model Outputs

The outputs generated by the AI models integrated into the Services are based on complex algorithms and may not always be accurate, complete, or appropriate for your needs. You are solely responsible for evaluating and using AI-generated outputs. Crompt AI does not guarantee the accuracy, reliability, or suitability of any AI-generated content.

10.3 Third-Party AI Providers

Crompt AI relies on third-party AI providers to deliver certain aspects of the Services. We are not responsible for any interruptions, errors, or limitations caused by these third-party providers, including changes to their terms, pricing, or availability.

11. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Crompt AI, its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or relating to your use of the Services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms or your use of the Services will not exceed the amount you paid for the Services in the six (6) months preceding the event giving rise to the claim, or INR 10,000, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Crompt AI, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and your use of the Services are governed by the laws of India, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered by the Indian Council of Arbitration (ICA) in accordance with its rules. The arbitration will be conducted in Surat, Gujarat, unless otherwise agreed by the parties. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction in Surat, Gujarat, to protect its intellectual property or other proprietary rights.

13.3 Consumer Disputes

If you are a consumer under the Consumer Protection Act, 2019, you may also have the right to file a complaint with the appropriate consumer dispute redressal commission in India. We encourage you to contact us first at support@crompt.ai to resolve any issues amicably.

14.1 Google Play Store

2.2 Dynamic Usage Limits

If you download the App from the Google Play Store, you acknowledge that these Terms are between you and Crompt AI, not Google, and that Google is not responsible for the App or its content. Google’s terms of service and policies also apply to your use of the App.

14.2 Apple App Store

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Crompt AI, not Apple, and that Apple is not responsible for the App or its content. Apple’s terms of service and policies also apply to your use of the App. In addition, you agree that:

• The license granted to you for the App is limited to a non-transferable license to use the App on an Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

• Apple has no obligation to provide maintenance or support services for the App.

• To the extent permitted by law, Apple is not responsible for any claims related to the App, including product liability, consumer protection, or intellectual property claims.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Crompt AI regarding the Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. C. Crompt AI may assign or transfer these Terms, in whole or in part, without restriction.

15.5 Force Majeure

Crompt AI will not be liable for any failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, or disruptions caused by third-party providers.

16. Additional Provisions for International Users

If you are accessing the Services from outside India, you are responsible for complying with all applicable local laws and regulations. The Services may not be available in all regions, and certain features may be restricted based on your location. We make no representation that the Services are appropriate or available for use in your jurisdiction.
